Výkon rodičovské odpovědnosti osobami ve výkonu trestu odnětí svobody

Abstract

The Diploma Thesis called The exercise of parental responsibility by persons serving prison sentence deals with the institute of parental responsibility, which means fulfilling and execution of rights and duties of parents serving prison sentence towards their underage children. Legal framework of this institute pursuant to current legislation in the Civil Code is described in detail in the theoretic part, the next part deals with the execution of sentence prison sentence as a specific life circumstance in which a human being is caught in as a parent. The research survey carried out in selected Czech penitentiaries for execution of prison sentence of men and women. The thesis analyses the current legislation of rights and duties of parents serving prison sentence and maps their carrying out in practice. Using the quantitative methodology, the results of the research survey show that rights and duties of parents acknowledged by legislation and in practice of the Constitutional court of the Czech Republic are substantially restricted during the execution of prison sentence. Diplomová práce s názvem Výkon rodičovské odpovědnosti osobami ve výkonu trestu odnětí svobody se zabývá institutem rodičovské odpovědnosti, tedy naplňováním a výkonem práv a povinností rodičů ve výkonu trestu odnětí svobody k jejich nezletilým dětem. V teoretické části je nejprve podrobně popsán právní rámec tohoto institutu dle aktuální právní úpravy občanského zákoníku, další část se věnuje výkonu trestu odnětí svobody jako specifické situaci, ve které se člověk jako rodič ocitá. Součástí praktické části je výzkumné šetření realizované ve vybraných českých věznicích pro výkon trestu odnětí svobody žen a mužů. Práce analyzuje aktuální právní úpravu práv a povinností rodičů ve výkonu trestu a mapuje jejich naplňování v praxi. Výsledky výzkumného šetření za použití kvantitativní metodologie ukazují, že práva a povinnosti přiznaná rodičům legislativou i judikaturou Ústavního soudu ČR jsou ve výkonu trestu výrazně omezena. Toto omezení je způsobeno systémovými, materiálními i zákonnými překážkami jak na straně odsouzeného rodiče, tak na straně věznice a dalších státních i nestátních subjektů, jež se mají podílet na podpoře udržování a rozvíjení vzájemných vztahů mezi rodičem ve výkonu trestu a jeho dětmi.
