Abstract

Administrative Sanctions in The Field of Gambling Abstract The dissertation "Administrative Sanctions in the Field of Gambling" focuses on the description and analysis of the extent to which the specificity of the regulation of gambling is reflected in the interpretation and application of the administrative criminal law in this sector. In this regard, the main attention is paid to how the principles of administrative punishment are applied in dealing with gambling offences, and this analysis is based mainly on specific administrative rulings of relevant administrative authorities, i.e., the Ministry of Finance and customs authorities. The basic aim of this thesis is to assess how the administrative sanctions are applied in the operation of gambling games from the point of view of fulfilling the basic principles and institutes of the administrative criminal law as well as to evaluate the extent to which the administrative punishment contributes to the fulfilment of the point and purpose of this public-law regulation, that is always with specific cases and situations in which the facts of the case of individual gambling offences are presented. Správní trestání v oblasti hazardních her Abstrakt Předmětná disertační práce "Správní trestání v oblasti hazardních her" se zaměřuje na popis a analýzu toho, do jaké míry se specifičnost regulace provozování hazardních her promítá do interpretace a aplikace norem správního práva trestního v tomto odvětví. V tomto směru je věnována hlavní pozornost tomu, jakým způsobem jsou aplikovány principy správního trestání v rámci projednávání hazardních přestupků, přičemž tato analýza se opírá o zejména konkrétní správní rozhodnutí vydaná příslušnými správními orgány, tj. Ministerstvem financí a orgány celní správy. Základním cílem této práce je zhodnocení, jakým způsobem je aplikováno správní trestání v oblasti provozování hazardních her z pohledu naplnění základních principů a institutů správního práva trestního a dále pak i posouzení, do jaké míry přispívá správní trestání k naplňování smyslu a účelu veřejnoprávní regulace této oblasti, a to vždy na konkrétních případech a situacích, v jejichž rámci dochází k naplňování skutkových podstat jednotlivých hazardních přestupků. Dalším z cílů této práce je mimo jiné posoudit, jakým způsobem se promítá celospolečenské vnímání hazardních her do rozhodovací činnosti správních orgánů příslušných k aplikaci správního trestání v oblasti hazardních her.
