Právní úprava obecné ochrany přírody a krajiny

Abstract

Diplomová práce se věnuje tématu právní úpravy obecné ochrany přírody a krajiny a svým rozsahem pokrývá zejména § 4-13 zákona č. 114/1992 Sb., o ochraně přírody a krajiny. Cílem práce je poskytnout ucelený přehled o nástrojích obecné ochrany přírody a krajiny, detailně je popsat a poukázat na legislativní nedostatky současné právní úpravy. V práci je uplatňována deskriptivní a analytická metoda. Práce je rozdělena do šesti kapitol. První kapitola je věnována úvodu do problematiky ochrany přírody a krajiny, seznamuje s nejdůležitějšími pojmy a představuje nástroje uplatňované v rámci ochrany přírody a krajiny. Druhá kapitola se věnuje nejvýznamnějším mezinárodním úmluvám v oblasti ochrany přírody a krajiny, k jejichž ratifikaci dal souhlas Parlament České republiky a jimiž je Česká republika vázána. Následující kapitola popisuje evropské předpisy týkající se ochrany přírody a krajiny. Největší pozornost je věnována čtvrté a páté kapitole. Čtvrtá kapitola popisuje právní úpravu obecné druhové ochrany přírody a krajiny. Věnuje se tedy problematice ochrany volně žijících živočichů a planě rostoucích rostlin včetně ochrany ptáků, která je v systematice zákona o ochraně přírody a krajiny vyčleněna samostatně. The diploma thesis is addressing legal regulation of nature and landscape protection and it is covering mostly sections 4-13 of the Act no. 114/1992 Coll, on protection of nature and landscape. The aim of the thesis is to provide comprehensive overview of the tools of nature and landscape general protection, describe them in detail and point out legislative shortcomings of current regulation. Descriptive and analytical method is being used in the thesis. The thesis is divided into six chapters. The first chapter is devoted to an introduction into issues linked to the protection of nature and landscape, it presents the most important terms and instruments used in the protection of nature and landscape. The second chapter is focusing on the major environmental international agreements of which the Parliament of the Czech Republic has given its consent to ratification and which are legally binding for the Czech Republic. The following chapter describes European legislation related to the protection of nature and landscape. The greatest regard is dedicated to the fourth and fifth chapter. The fourth chapter describes legal regulation of general protection of species.
