Abstract

Pojetí trestného činu v českém trestním zákoníku Abstrakt Předkládaná diplomová práce se zabývá otázkou pojmu a zejména pojetí trestného činu. Spáchání trestného činu je výlučným předpokladem pro vyvozování trestní odpovědnosti, navzdory jeho zásadnímu významu pro trestní právo hmotné i procesní však stran jeho pojetí v účinném trestním zákoníku zůstávají dílčí teoretické i aplikační nejasnosti. Tato práce si klade za cíl komplexně prozkoumat způsob, jakým bylo do trestního zákoníku zakotveno pojetí trestného činu, a to od obecných teoretických otázek, účinné právní úpravy včetně její historické geneze, až po upozornění na některé nedostatky právní úpravy a jejich možných řešení prostřednictvím návrhů de lege ferenda. První kapitola této práce je věnována vymezení výchozích pojmů, ze kterých trestný čin vychází. Dále se zabývá teoretickými modely pojmu a pojetí trestného činu, kterých může zákonodárce při konstrukci normativního textu využít, a popisuje jejich největší přednosti i slabiny. Věnuje se rovněž jejich vzájemným kombinacím. Další část práce se zaměřuje na genezi právní úpravy pojmu a pojetí trestného činu v moderních kodexech trestního práva na našem území, věnuje se prvorepublikovým osnovám trestního zákona z let 1926 a 1937, které nakonec nebyly přijaty do podoby zákona, a dále trestním zákonům...

The Concept of a Criminal Offence in the Czech Criminal Code Abstract The presented thesis deals with the matter of the concept and particularly of the conception of a criminal offence. Committing a criminal offence is an exclusive requirement for establishing criminal liability. Despite its significance for substantive and procedural criminal law, there are still both some academic and practical uncertainties concerning its conception in the criminal code in force. This thesis aims to thoroughly explore the conception of the criminal offence in the criminal code, starting from the basic theoretical questions, current legislation in force including its historical development and finally to highlight some legislative issues and its possible solutions through de lege ferenda proposals. The first chapter of this thesis concerns with the matter of defining basic concepts that the criminal offence is based on. It further deals with the theoretical models of conception and concept of the criminal offence that might be used by the legislator while creating the law and describes its strengths and weaknesses.
