Koncepce rodiny a její ochrany v českém a evropském měřítku

Abstract

Disertační práce se věnuje problematice koncepce rodiny a její ochrany, a to jak na evropské úrovni, tak i v mezích české soukromoprávní úpravy.Cílem práce je zmapování současných evropských standardů úpravyrodinného života ve vztahu ke stejnopohlavním párům a nesezdaným soužitím, představujícím vedle nukleární rodiny dva typické modelyrodinného soužití. Evropský rozměr dané problematiky je v disertační práci zkoumán v rámci analýzy právních úprav členských států EU a dáleve světle rozhodovací činnosti ESLP. Zároveň disertační práce pojednává o české soukromoprávní úpravě stejnopohlavních svazků a nesezdaného soužití v kontextu evropských standardů, reflektuje nedostatky aktuální právní úpravy a zahrnuje i úvahy de lege ferenda.

The dissertation deals with the concept of family and its protection on the European scale and within the Czech private law. The main aim of the dissertation is to map the current European standards of the law on family life related to same-sex couples and cohabitations representing (together with a nuclear family) the typical family models. The European scale of the aforesaid issue is focused on analysis of EU member states' legislations and the case-law of the ECHR. Last but not least, the dissertation deals with the Czech private law on same-sex unions and cohabitations in the context of the European standards, reflects the shortcomings of current legislation and includes considerations de lege ferenda.
