Secondary insolvency proceedings, regulation on insolvency proceedings, bankruptcy of Arca InvestmentsMezinárodní insolvenční právo Vzhledem k široké problematice mezinárodního insolvenčního práva je téma diplomové práce zúženo na vedlejšího řízení ve smyslu Nařízení o insolvenci. Cílem je zodpovězení výzkumné otázky: je právní úprava vedlejšího řízení dle Nařízení o insolvenci vhodná pro dosažení cílů vedlejšího řízení, tedy pro ochranu místních a jiných zájmů a pro účinnou správu majetku, jakož i pro dosažení cíle Nařízení o insolvenci, tedy pro účinné vedení přeshraničních insolvenčních řízení? Stanovena je také následující výzkumná podotázka: v čem je právní úprava vedlejšího řízení v Nařízení o insolvenci k dosažení cílů vedlejšího řízení a Nařízení o insolvenci vhodná a v čem nevhodná? Autor popisuje klíčové teoretické koncepty mezinárodního insolvenčního práva, historický vývoj evropského insolvenčního práva a typy řízení dle Nařízení o insolvenci. Hlavní část diplomové práce podává analýzu vedlejšího řízení a jeho jednotlivých institutů. Pozornost je věnována zejména zahájení vedlejšího řízení, koordinaci s řízením hlavním, kde jsou popsány jak pravomoci hlavního správce, tak spolupráce mezi aktéry obou řízení. Analýza je zaměřena také na majetkovou podstatu a uplatňování pohledávek ve vedlejším řízení, jakož i na institut příslibu insolvenčního správce. V této části práce jsou vymezena...
International insolvency law Due to the broad scope of international insolvency law, the topic of the thesis is narrowed down to the issue of secondary insolvency proceedings within the meaning of the Insolvency Regulation. The aim is to answer the research question: is the regulation of secondary proceedings under the Insolvency Regulation suitable for achieving the objectives of ancillary proceedings, i.e. the protection of local and other interests and the efficient administration of assets, as well as for achieving the objective of the Insolvency Regulation, i.e. the efficient conduct of cross-border insolvency proceedings? The research sub-question of the thesis is: in what ways is the regulation of secondary proceedings in the Insolvency Regulation appropriate and in what ways is it inappropriate to achieve the objectives of secondary proceedings and the Insolvency Regulation? The author describes the key theoretical concepts, the historical development of European insolvency law and briefly the types of proceedings under the Insolvency Regulation. The main part of the thesis provides an analysis of secondary proceedings and its institutes.
