Komparace europeizace v oblasti justice a vnitra v Moldavsku a na Ukrajině

Abstract

This diploma thesis examines the theoretical concept of Europeanization in the context of the Russian invasion of Ukraine on 24 February 2022. The ambition of this thesis is to compare the relative levels of Europeanisation in the field of justice and home affairs in Moldova and Ukraine and then place it in the context of the Russian aggression. The aim of this thesis is to determine whether both countries were sufficiently Europeanised prior to receiving candidate status, or whether this EU move was solely a reaction to Russian aggression. Europeanisation theory was chosen because it examines a process that is crucial for EU accession. In this case, it was defined as the degree of approximation of national legislations to the EU acquis in the field of justice and home affairs. The integration process is a natural response of states to external threats, but also an opportunity for economic integration and shared prosperity. This thesis therefore examines the motivations, but also the obstacles, that shape the bilateral relations between the EU and the countries aspiring to EU membership. Tato diplomová práce se zabývá teoretickým konceptem europeizace v kontextu ruské invaze na Ukrajinu 24. února 2022. Ambicí této práce je porovnání relativní úrovně europeizace v oblasti justice a vnitra v Moldavsku a na Ukrajině a následné zasazení do kontextu ruské agrese. Cílem této diplomové práce je zjistit, zdali byly obě země před obdržením kandidátského statusu dostatečně europeizované, nebo byl tento krok EU reakcí na ruskou agresi. Teorie europeizace byla vybrána proto, neboť zkoumá proces, jenž je pro přistoupení do EU klíčový. V tomto případě byla definována jako míra aproximace národních legislativ k acquis EU v oblasti justice a vnitra. Integrační proces je přirozenou reakcí států na vnější hrozby, ale zároveň příležitostí k ekonomické integraci a společné prosperitě. Tato práce tedy zkoumá motivace, ale i překážky, které formují vzájemné bilaterální vztahy mezi EU a zeměmi aspirujícími na členství v EU. V neposlední řadě zasazuje výsledky analytické části práce do širšího kontextu a podrobuje kritické diskuzi, aby určila, zdali bylo udělení kandidátského statusu Moldavsku a Ukrajině ojedinělým postupem EU nebo zda jsou tyto země již dostatečně europeizované.
