Remote work, Labour law, Labour codePráce na dálku Abstrakt Rigorózní práce se zabývá problematikou práce na dálku, resp. mobilní práce. Nejprve v kapitole první vymezuje pojem mobilní práce, vypořádává se s nesjednocenou terminologií v odborné literatuře i praxi. Poté práce analyzuje úpravu mobilní práce de lege lata, přičemž na konkrétních příkladech dokládá, že jak praxe, tak odborná veřejnost, MPSV i zákonodárce (prostřednictvím příslušné důvodové zprávy) nezřídka za úpravu mobilní práce považují ustanovení § 317 ZP. Takový přístup poté rigorózní práce kriticky přezkoumává, přičemž ustanovení § 317 ZP identifikuje jako relikt historického právního institutu tzv. domáckého zaměstnávání, a to mimo jiné za pomoci přímé komparace textace § 317 ZP s relevantní historickou právní úpravou. Rigorózní práce tak dochází k závěru, že mobilní práce stricto sensu zákonem upravena není, byť úprava domáckého zaměstnávání vykazuje s mobilní prací značnou podobu. Následně analyzuje samotné znění § 317 ZP a dochází k závěru, že se jedná o úpravu, která není úplně vyhovující. Následuje pojednání o dispozitivním charakteru ZP, včetně exkursu do vývoje této problematiky od zákona č. 65/1965 Sb., zákoníku práce do současnosti, a to včetně vlivu přelomového nálezu Ústavního soudu. Remote Work Abstract This thesis deals with the issue of remote work, or in other words, mobile work as this thesis calls it. In the first chapter, the concept of mobile work is defined, while the lack of unified terminology in both, academic literature and practice, is addressed. The thesis then analyses the current legal framework concerning mobile work, demonstrating through specific examples that practice, expert community, as well as the Ministry of Labour and Social Affairs and the legislator (through the respective explanatory report), often consider the provisions of Section 317 of the Labour Code as the regulation of mobile work. The thesis critically examines this approach, identifying Section 317 of the Labour Code as a relic of the historical legal institute of so-called home employment, concluding so, among other thigs, on the basis of a direct comparison of the wording of Section 317 of the Labour Code with relevant historical legal regulation. Consequently, the thesis concludes that mobile work per se, strictly speaking, is not regulated by the law, even though the regulation of home employment bears a significant resemblance to mobile work.
