Trendy a změny ve výkonu práce z domova v posledních letech

Abstract

Diplomová práce je rozdělena na dvě části, první část je pojatá jako teoretická, která se zabývá trendy ve vývoji legislativní úpravy práce z domova a legislativním procesem návrhu novel zákoníku práce z roku 2016 a z roku 2022. Pro kontext celého institut práce z domova je v první části diplomové práce zmíněn i historický vývoj práce z domova. Novela zákoníku práce z roku 2022 je podrobněji rozebrána a je popsán i její legislativní proces. Cílem diplomové práce bylo zhodnotit původní právní úpravu práce z domova a navrhované novely. Jako pramen původní právní úpravy práce z domova je v diplomové práci označován zákon č. 262/2006 Sb., zákoník práce, který byl planý a účinný do 30. 9. 2023. V rámci práce z domova se diplomová práce věnuje podrobněji náhradám nákladů a bezpečnosti ochrany a zdraví při práci z domova. Jelikož práci z domova nelze uchopit odděleně od jiné problematiky, tak se okrajově diplomová práce dotýká i institutů související s prací z domova a to: daním v souvislosti s jiným místem výkonu práce a práci z domova ve vztahu k životnímu prostředí. V druhé části se diplomová práce věnuje praktickému výzkumu práce z domova z období před celosvětovou pandemií Covid-19, v průběhu pandemie a po pandemii. The diploma thesis is divided into two parts, the first part is conceived as theoretical, which deals with the trends in the development of the legislative regulation of work from home and the legislative process of the draft amendments to the Labor Code from 2016 and from 2022. For the context of the entire institute of work from home, in the first the historical development of working from home is also mentioned in the thesis. The 2022 amendment to the Labor Code is analyzed in more detail and its legislative process is also described. The aim of the thesis was to evaluate the original legislation on working from home and the proposed amendments. Act no. 262/2006 Coll., the Labor Code, which was void and effective until 30/09/2023. Within the framework of working from home, the diploma thesis deals in more detail with reimbursement of costs and safety, health and protection when working from home. Since working from home cannot be grasped separately from other issues, the diploma thesis marginally touches on institutes related to working from home, namely: taxes in connection with another place of work performance and working from home in relation to the environment.
