Abstract

Thesis Title The Technical Means of Forestalling Further Vehicle Movement: Legality, Proportionality, and Other Application Problems Abstract This thesis analyses the institute of the technical means of forestalling further vehicle movement, the so called "clamp", from a theoretical and applicational viewpoint. Its aim is to present a detailed description of this institute, explain the modes within which it is used and the differences among those modes of application, and present the differences of applying this institute by different authorised authorities (i.e. Police of the Czech Republic, Customs Organisation of the Czech Republic, municipal police). This thesis also aims to analyse the contemporary use of this institute in practice, namely concentrating on the frequency, methodology, and legality of this application. A substantial part of this thesis consists of the research and analysis of the expenses of the use of the afore-mentioned institute. The focus of the analysis of expenses is on their legal grounding, character and the circumstances taken into consideration when determining the full extent of the expenses regarding specific cases. Název práce Technický prostředek k zabránění odjezdu vozidla: Legalita, proporcionalita a další aplikační problémy Abstrakt Tato práce zkoumá institut technického prostředku k zabránění odjezdu vozidla (TPZOV), tzv. "botičky" z teoretického a aplikačního hlediska. Cílem práce je tento institut podrobně popsat a vysvětlit režimy, ve kterých se TPZOV používá, dále rozdíly mezi těmito jednotlivými režimy použití a rozdíly v použití TPZOV jednotlivými k tomu oprávněnými orgány (Policie České republiky, Celní správa České republiky, obecní policie). Dále si práce klade za cíl analyzovat současné využití tohoto institutu v praxi, a to z hlediska četnosti, metodiky a legality jeho použití. Významnou část práce tvoří výzkum a analýza nákladů na použití TPZOV. U těchto nákladů je zkoumáno především jejich právní zakotvení, povaha a okolnosti, které jsou zohledňovány při určení jejich výše v konkrétních případech. Na základě takto získaných poznatků je pak závěrečná část práce věnována úvahám nad možnostmi zlepšení současného stavu. TPZOV je v současnosti využíván ve třech režimech, a to v režimu donucovacího prostředku, zajišťovacího prostředku a zvláštního zajišťovacího prostředku k vynucení splnění vykonatelného správního trestu ve formě pokuty.
