Abstract

Changes in EU trademark law and their reflection in Czech trademark law Abstract This thesis deals with the recent reform of EU trademark law and its impact on Czech trademark law. Main goals of the thesis are to summarise the changes introduced by the reform, analyse in detail the individual legal institutions most impacted by the reform, explain newly established legal institutions, examine how the changes in EU trademark law impacted Czech trademark law, and assess whether the changes represent a step in the right direction. The first part serves as a general introduction to trademarks and it characterises them mainly by their specific functions. The second part illustrates the evolution of international trademark law by brief examination of the most significant treaties and conventions. The international trademark law provides important context for understanding the EU and national trademark law. The third part focuses on Czech trademark law. It compares the differences regarding the individual legal institutions before and after the reform. Změny ve známkovém právu EU a jejich promítnutí v české známkové úpravě Abstrakt Práce se zabývá nedávnou reformou unijního známkového práva a jejími dopady na české známkové právo. Klade si za cíl změny zavedené reformou celkově shrnout, podrobně rozebrat jednotlivé instituty, jež byly reformou dotčeny nejvýrazněji, vysvětlit instituty nově zavedené, prozkoumat vliv změn unijní úpravy na českou úpravu, a zhodnotit, zda změny znamenají kroky správným směrem. První část slouží k obecnému představení institutu ochranné známky. Ochranná známka je zde charakterizována zejména prostřednictvím jejích jednotlivých funkcí. Druhá část naznačuje vývoj mezinárodní úrovně známkoprávní ochrany pomocí stručného rozboru nejvýznamnějších mezinárodních smluv. Uvedení kontextu mezinárodní úpravy je důležité pro pochopení unijní i národní úpravy. Třetí část je věnována české úpravě ochranných známek. U jednotlivých institutů, jež prošly nejzásadnějšími změnami, je porovnán vždy stav před reformou a po ní. Jedná se zejména o samotnou zákonnou definici ochranné známky, nové druhy ochranných známek, kolektivní ochranné známky, důvody zápisné nezpůsobilosti, a dále procesní změny v rámci zápisného řízení a též řízení o zrušení či prohlášení ochranné známky za neplatnou.
