Abstract

1 Abstract Protection of property rights and the enviroment In this diploma thesis I deal with the relationship between environmental protection and property law. I divide it into four parts. In the first one, I describe the right to property, the limits of the right to property, expropriation for environmental protection, the ownership of individual components of the environment, environmental protection and the conflict between the right to property and the protection of the environment. In it, I deal specifically with the ownership of waters, wildlife, mineral wealth and caves. The second part focuses on the types of restrictions on property rights for environmental protection and their typology. It is a division into internal and external, according to the method of origin and according to the obligations imposed on the addressee. In it, I also define the public and general interest. In the third part, I discuss the limitations for the protection of agricultural land, forest protection, water protection, and the protection of nature and landscape. Ochrana životního prostředí a vlastnické právo V této diplomové práci se zabývám vztahem ochrany životního prostředí a vlastnického práva. Člením ji do čtyř částí. V první popisuji vlastnické právo, meze vlastnického práva, vyvlastnění pro ochranu životního prostředí, vlastnictví jednotlivých složek životního prostředí, ochranu životního prostředí a střet mezi vlastnickým právem a ochranou životního prostředí. Zabývám se v ní konkrétně vlastnictvím vod, volně žijících živočichů, nerostného bohatství a jeskyň. Druhá část se soustředí na druhy omezení vlastnického práva pro ochranu životního prostředí a jejich typologii. Jedná se o dělení na vnitřní a vnější, podle způsobu vzniku a podle povinností uložených adresátu. Vymezuji v ní také veřejný a obecný zájem. Ve třetí části rozebírám omezení pro ochranu zemědělského půdního fondu, ochranu lesa, ochranu vod a přírody a krajiny. Zabývám se principy ochrany zemědělského půdního fondu a povinnostmi vlastníka při hospodařením na něm, změnou druhu zemědělské půdy, hospodařením v lese, obecným užíváním lesů, omezeními a zákazy při ochraně lesů a úpravou náhrad v lesním zákoně. V ochraně vod rozebírám plošnou ochranu vod, náhrady v zákonu o vodách, práva a povinnosti vlastníků koryta, ochranu před povodněmi a omezení související s prováděním nápravných...
