Abstract

Nadřízený orgán škol a školských zařízení podle zákona o svobodném přístupu k informacím Abstrakt Diplomová práce se zaměřuje na určení nadřízeného orgánu škol a školských zařízení podle zákona č. 106/1999 Sb., o svobodném přístupu k informacím, ve znění pozdějších předpisů (dále jen "informační zákon"). Autor práce rozebírá problematiku z pohledu teorie, ale také z hlediska praxe. Obsahem první kapitoly teoretické části práce je rozbor určení nadřízených orgánů podle úpravy informačního zákona a zákona č. 500/2004 Sb., správní řád, ve znění pozdějších předpisů. Druhá kapitola teoretické části se zaměřuje na vymezení pojmu škol a školských zařízení, právnických osob jejich činnost vykonávajících a pojetí povinného subjektu dle informačního zákona. Třetí kapitola teoretické části je věnována kategorizaci jednotlivých škol a školských zařízení, které autor člení podle rozdílnosti postupů určení nadřízeného orgánu a podle správního orgánu, který byl určen za nadřízený orgán povinných subjektů podle informačního zákona. Autor dále v této kapitole uvádí konkurenční způsoby určení, které došly k určení jiného nadřízeného orgánu některých škol a školských zařízení, a to s rozborem věnovaným správnosti či nesprávnosti takového postupu. Supervisory authority of schools and educational establishments under the Freedom of Information Act Abstract The thesis focuses on the determination of the superior authority of schools and educational institutions according to Act No. 106/1999 Coll., on free access to information, as amended (hereinafter referred to as the "Information Act"). The author of the thesis analyses the issue from the point of view of theory, but also from the point of view of practice. The content of the first chapter of the theoretical part of the thesis is an analysis of the determination of superior authorities according to the regulation of the Information Act and Act No. 500/2004 Coll., Administrative Procedure Code, as amended. The second chapter of the theoretical part focuses on the definition of the concept of schools and educational establishments, legal entities performing their activities and the concept of a mandatory subject according to the Information Act.
