Vybraná témata ze života učitele 2. stupně základní školy pohledem práva

Abstract

Diplomová práce se zabývá vybranými tématy ze života učitele 2. stupně základní školy pohledem práva. Jedná se zejména o témata, která se v praxi ukázala začínajícím, ale často i zkušeným učitelům jako nejasná či nedostatečně nastudovaná pro působení na základní škole. Práce se tedy zabývá zejména předpoklady pro výkon činnosti učitele 2. stupně základní školy s důrazem na odbornou kvalifikaci a aprobace v komparaci s kompetentností a aktuální snahou o standardizaci učitelské profese v rámci Strategie 2030+. Dále se věnuje právem a povinnostem učitelů 2. stupně základní školy, a to jak vůči žákům a rodičům, tak i zaměstnavateli dle aktuálně platné legislativy. Práce se zaměřuje mj. na práva a povinnosti třídního učitele a formy dalšího vzdělávání pedagogických pracovníků. Výklad neopomíjí ani pracovněprávní aspekt školství, tedy zejména legislativní zakotvení pracovní doby učitele 2. stupně základní školy, konkrétněji rozsah pracovní doby a s tím spojenou diferenciaci mezi přímou pedagogickou činností a činností související s přímou pedagogickou činností. V závěru se věnuje specifikům čerpání a rozsahu dovolené pedagogických pracovníků. Cílem práce je tedy tyto tematické celky objasnit a představit tak systematicky ucelený výklad, který může sloužit jako odrazový můstek nejen pro začínající učitele...

The thesis deals with selected topics from the life of a lower secondary school teacher from the perspective of the Czech legal system. In particular, these are topics that appeared to not only novice teachers during their teaching experience as unclear or insufficiently studied for the scope of their job. The thesis therefore deals primarily with prerequisites for the performance of the activity of a lower secondary school teacher with emphasis on professional qualification and teaching specialization in comparison with competence and current efforts to standardize the teaching profession within the framework of the 2030+ Strategy. Furthermore, it deals with the rights and responsibilities of secondary lower school teachers, both vis-à-vis pupils and parents and vis-à-vis the employer according to the legislation currently in force. The thesis is also focused on the rights and obligations of the class teacher and the forms of further education of pedagogical staff. Finally, the thesis focuses on education in the context of labour law, namely the legislative anchoring of the working time of a secondary lower school teacher.
