Abstract

Trestní odpovědnost ve sportu Abstrakt Rigorózní práce se zaměřuje na téma trestní odpovědnost ve sportu. Trestní odpovědnost ve sportu, z pohledu autora, představuje v současnosti stále častěji diskutované téma. Trestní odpovědnost ve sportu se týká situací, kdy dojde v rámci výkonu sportu a sportovní činnosti k porušení právních předpisů, typicky předpisů trestního práva. Úvodní kapitola práce, proto pojednává o pojmu trestní odpovědnosti a trestného činu. Popisuje skutkovou podstatu trestného činu, její obligatorní znaky, jakou jsou objekt, objektivní stránka, pachatel a subjektivní stránka. V kontextu daného tématu zohledňuje i okolnosti vylučující protiprávnost, a tom zejména ty, které jsou v kontextu této práce, aktuální. Přípustné riziko a svolení poškozeného. Druhá kapitola vymezuje pojem sport, jeho definici a zákonné zakotvení. Předkládá nejednu definici sportu, z nichž následně vybírá tu, dle autora, nejvhodnější a některé další hodnotí ze současného pohledu a pohledu této práce. Třetí kapitola se zabývá vztahem mezi sportem a právem, když i zde je krátký historický exkurz a geneze k současnému stavu. Zabývá se otázkou, zda a jaký je vztah mezi sportem a právem.
