Determinace způsobu spáchání trestného činu

Abstract

Diplomová práce pojednává o fenoménu determinace způsobu spáchání trestného činu. V úvodní části se diplomová práce věnuje vymezení základní problematiky způsobu, jakým může být trestný čin spáchán, a podává přehled historického vývoje. Pro ilustraci dané problematiky je uveden výběr definic způsobu spáchání trestné činnosti od různých autorů věnujících se danému tématu. Následující kapitoly pojednávají o třídění komponentů, na něž lze způsob páchání trestné činnosti rozložit a analyzovat pro hlubší poznání dané problematiky. Komponenty jsou členěny dle předmětné povahy na dějové a věcné a dle složitosti na základní, komplexní a dílčí komponenty. Třetí a zároveň nejobsáhlejší část práce se věnuje determinaci způsobu spáchání trestné činnosti. Důraz je kladen na výklad jednotlivých determinantů, které jsou členěny na determinanty objektivní a subjektivní, dle míry jejich závislosti na pachateli trestného činu. Diplomová práce nabízí komplexní výklad determinantů a spojuje je s příklady z kriminalistické praxe. Poslední kapitola diplomové práce rozpracovává význam a praktické využití, které je poznání způsobu spáchání trestného činu schopné poskytnout. Důraz je kladen na vytváření vyšetřovacích verzí, prevenci kriminality a modus operandi systémy.

The diploma thesis deals with the phenomenon of determining the method of committing a crime. In the introductory part, the diploma thesis is devoted to the definition of the basic issue of the way in which a criminal offense can be committed and gives an overview of the historical development. To illustrate the issue, a selection of definitions of the method of committing a criminal activity from various authors devoted to the given topic is presented. The following chapters deal with the classification of components into which the method of committing a criminal activity can be broken down and analyzed for a deeper understanding of the given issue. The components are divided according to their character and their degree of complexity into basic, complex and sub-components. The third part of the work and at the same time the most comprehensive part is devoted to the determination of the method of committing a criminal activity. Emphasis is placed on the interpretation of determinants, which are divided into objective and subjective determinants, according to the degree of their dependence on the perpetrator of the crime.
