Procesní aspekty určení otcovství

Abstract

Diplomová práce pojednává o procesních aspektech určení otcovství po rekodifikaci soukromého práva, kdy došlo k přesunu právní regulace z občanského soudního řádu do zákona o zvláštních řízeních soudních a současně též ke změně celkové koncepce chápání těchto řízení. Práce si klade za cíl popsat vybrané procesní aspekty určení otcovství, upozornit na klady a zápory současné právní úpravy a pokusit se navrhnout řešení de lege ferenda. Cílem práce je rovněž provést analýzu současné rozhodovací praxe vybraných českých soudů prvního stupně a zhodnotit, jak je popsaná právní úprava aplikována.

The diploma thesis deals with the procedural aspects to determination of paternity after the recodification of private law which resulted in a change in the overall concept of understanding these proceedings. The thesis aims to describe selected procedural aspects to determination of paternity, to draw attention to the pros and cons of current legislation and to try to propose a solution de lege ferenda. The thesis also analyses the current decision-making practice of selected Czech courts of first instance and evaluates how the described legislation is applied.
