Abstract

Vybrané právní aspekty v oblasti IT Abstrakt Rigorózní práce s názvem "Vybrané právní aspekty v oblasti IT" se z teoretického a praktického hlediska zaměřuje na specifické oblasti, které mohou z právního hlediska vznikat při nakládání s počítačovým programem a obecně se software. Na úvod práce je stručně popsán vývoj autorskoprávní ochrany děl a postupný způsob zakotvování této ochrany do právních předpisů. Vývoj je popisován jak na lokální úrovni v České republice, tak i na mezinárodní úrovní, která má v této oblasti velmi podstatný vliv (nejen na formování národních právních řádů). Tímto popisem chce autor zdůraznit potřebu efektivní ochrany autorských práv v dnešním globalizován světě. Druhá kapitola detailně analyzuje životní cyklus počítačového programu a jeho význam v dnešní společnosti, kde software proniká do každodenního života každého z nás. Zde jsou popisovány detailně aspekty a procesy spojené se softwarem a jeho vývojem, výrobou a servisní podporou. V druhé kapitole je taktéž rozebrána otázka ukončení spolupráce mezi dodavatelem software a objednatelem, kde jsou zároveň popsány související otázky a úskalí spojená s tímto procesem. Specific legal aspects in the field of IT Abstract The thesis entitled "Specific Legal Aspects in the IT Field" focuses on specific areas that may arise from a theoretical and practical point of view when dealing with computer programme and software in general. At the beginning of the thesis, a brief description of the development of copyright protection of works and the gradual way of enshrining this protection in legislation is presented. The development is described both at the local level in the Czech Republic and at the international level, which has a very significant influence in this area (not only on the formation of national legal regimes). With this description, the author wants to emphasize the need for effective copyright protection in today's globalized world. The second chapter of the thesis analyses in detail the life cycle of a computer program and its importance today, where software permeates everyone's daily life. Here the aspects and processes associated with software and its development, production and service support are described in detail. In the second chapter, the issue of termination of cooperation between the software provider and its user is also discussed, where the related issues and pitfalls associated with this process are also described.
