52 6. ZÁVĚR Mediace, jak jsem se snažila ukázat v této diplomové práci, je velmi aktuálním tématem. Na základě komparace právních úprav v Německu, na Slovensku a v Rakousku, kterou jsem provedla, je možné vidět, že okolní státy se intenzivně zprostředkováním zabývají. Navíc i Evropská unie svým postojem a především přijetím směrnice o některých aspektech mediace v občanských a obchodních věcech mediaci podporuje a zavazuje státy k vnitrostátní úpravě tohoto institutu. Směrnice se dotýká pouze sporů s přeshraničním prvkem, ale myslím si, že při příležitosti její transformace do českého právního řádu, by bylo vhodné, upravit i zprostředkování vnitrostátních sporů. Z tohoto důvodu velmi vítám iniciativu Ministerstva spravedlivosti České republiky, jehož expertní skupina se pustila do vytvoření návrhu zákona o mediaci v netrestních věcech. Zákon je ve stadiu paragrafovaného znění, ale zatím nebyl vládě předložen ke schválení. Domnívám se, že navrhovaná úprava se pokusila pojmout mediaci v jejím celku a upravit její nejdůležitější aspekty. Na druhou stranu má i své nedostatky, na které jsem se snažila v práci upozornit. Mediaci jako alternativní metodu řešení sporů nepovažuji za "všelék". Jako každý jiný právní institut má i zprostředkování své přednosti i nedostatky. Za její největší klad spatřuji především...
58 THE PERSPECTIVES OF MEDIATION IN CIVIL MATTERS Mediation belongs to the methods of alternative dispute resolution (ADR), which constitute an alternative to the classical legal proceeding. It could be defined as a procedure of finding a solution of a dispute with the help of a third neutral and impartial person - so called mediator. In opposite to the legal proceeding in front of a court, the solution is not authoritatively decided by the mediator, but the parties themselves decide their dispute. Mediation is based on voluntariness. It means that the parties should agree on the procedure of mediation as well as on the personality of the mediator. The role of the mediator consists in encouraging the communication between the parties and in showing them, that their conflict has many ways how it could be solved. Mediation is an actual topic in discussions on international, European as well as on national level. The European Union maintains the development of alternative dispute resolutions. A Directive 2008/52/EC on certain aspects of mediation in civil and commercial matters obligates the member states to transform the regulation on mediation in cross-border disputes into their legal order.
