housing cooperatives, cooperative apartment, transfer of an apartmentTato práce se zabývá bydlením v prostředí bytových družstev. V úvodu vysvětluje obecné charakteristiky bytového fondu a jeho dlouhou historii. Další část práce se podrobně zabývá základy právní úpravy družstev, konkrétně právními a majetkovými aspekty družstva podle obchodního zákoníku, účinného od 1. 1. 1992. Zaměřuje se jednak na podmínky založení družstva, zrušení a zánik družstva, otázky spojené se členstvím v družstvu a práva člena bytového družstva. Vzhledem k tomu, že právní úprava bytových družstev v obchodním zákoníku je velmi obecná, je postavení členů družstev, včetně jejich práv a povinnosti, detailněji upraveno stanovami příslušného družstva. Další část práce se zabývá otázkami týkajícími se vlastnictví bytu, který byl původně ve vlastnictví bytového družstva. V souvislosti s transformací již existujících bytových družstev, kdy právní úprava převodu bytu v těchto družstvech je založena převážně na adaptaci na nové podmínky sociální ekonomiky v České republice v 90. letech 20. století, byla bytová družstva povinna převést družstevní byty zdarma do vlastnictví jejich uživatelů (při splnění podmínek stanovených v transformačním zákoně č. 42/1992 Sb. a v zákoně o vlastnictví bytů, zákon č. 72/1994 Sb.), kteří jsou členy družstva, mají právo na pronájem bytu a požádali družstvo o převod v zákonné...
This thesis deals with housing in terms of housing cooperatives. The introduction explains the general characteristics of housing stock with its long history. The next part of the thesis elaborately deals with the basics of the legal regulation of the cooperatives according to the Commercial Code. There are legal and property characteristics of a cooperative in Commercial code, effective from 1. 1. 1992. There are rules emendating the establishment of a cooperative, the abolition and the termination of a cooperative, questions connected to membership in a cooperative and to rights of a member of a housing cooperative, in the Commercial Code. However, since the legal adaptation of housing cooperatives in Commercial code is very general, the position of the members of these cooperatives, including theirs rights and obligations, is regulated by their statutes. The members control the substantial matters of cooperative by collectively elected authority (usually board of directors) or at the general members meeting.
