Abstract

v českém jazyce - Aplikace principu non-refoulement na moři Účelem této práce je zjistit, jak se aplikuje významný princip mezinárodního práva, a sice princip non-refoulement na moři a jaké otázky si mají státy tímto principem vázané klást, pokud jej chtějí důsledně aplikovat. Vlastní text práce se skládá ze tří hlavních kapitol. První kapitola se věnuje non-refoulement obecně a vymezuje obsah a zakotvení tohoto principu v mezinárodních i regionálních dokumentech. Zkoumám též, jaké jsou aspekty zákazu refoulement jako obyčejového práva a zda jej můžeme v dnešní době považovat za mezinárodní obyčej, či nikoliv. V druhé kapitole se objevuje exkurs do mořského práva a nezbytné vymezení jednotlivých pásem moře na vnitřní vody, pobřežní vody, přilehlé pásmo a volné moře. V této kapitole se též zaměřuji na možnost aplikace non refoulement mimo hranice státu, tj. jeho extrateritoriální účinek. V neposlední řadě je třeba ve vztahu k operacím prováděným na moři vymezit jejich charakter a odlišná práva a povinnosti z nich vyplývající. V podkapitolách se objevuje problematika operací "pátrání a záchrany" neboli "search and rescue" a dále též problematika námořních zábranných programů, přičemž je zde rozebrán případ lodi Tampa a rozhodnutí amerického Nejvyššího soudu ve věci Sale, Acting Commissioner, INS v....

in English - The application of the non-refoulement principle at sea The aim of my thesis is to analyse how one of very important principles of the international law- the non-refoulement principle is applied at sea and what questions should the states bound by this principle ask in order to apply it properly. The thesis itself is composed of three main chapters. Chapter One deals with the non-refoulement in general and defines its content and how this principle is enshrined in international and regional documents. I also examine what are the aspects of the prohibition of refoulement in customary law and whether can it be at present considered as Customary International Law or not. In Chapter Two the excursion into Maritime Law occurs and also indispensable definition of individual maritime zones of Internal Waters, Territorial Waters, Contiguous Zone and High Seas is provided. In this chapter I also focus on the possible application of the non- refoulement outside the state's territory, i.e. its extraterritorial impact. Last but not least in regard to the operations held at sea it is necessary to define their character and different rights and duties arising from them.
