La violence de la loi et le problème de la justice chez Benjamin et Derrida

Abstract

The aim of the present study is to reveal the problematic relation between violence, law and justice by the thought of Walter Benjamin and Jacques Derrida. Following the argument that violence is inherent to the law and power, we discuss the problematic situation of justice. In this context, while Benjamin finds the "possibility" of the justice beyond the sphere of the law and power, Derrida shows us how the justice is an experience of impossibility doing deconstruction of the law. We conclude that justice cannot be reduced to the violence and to the limits of the political-juridical system. Résumé : Le but de ce mémoire consiste à révéler le rapport problématique entre la violence, le droit et la justice à travers la pensée de Walter Benjamin et Jacques Derrida. En suivant la thèse selon laquelle la violence est inhérente au droit et au pouvoir. Dans ce contexte, tandis que Benjamin trouve la possibilité de la justice au delà de droit, Derrida nous montre comment la justice est une expérience de l'impossibilité en faisant la déconstruction du droit. Nous concluons que la justice ne peut pas se réduire à la violence et aux limites du pouvoir étatico-juridique.
