Postavenie dieťaťa v medzinárodných dokumentoch

Abstract

Children's rights and protection principles are today's current issue which is becoming increasing public interest. The rigorous thesis, as is already clear from its title, deals with children's rights in international documents. As a goal of the thesis is the analyse of the children status and its protection in areas which are problematic and need a deeper investigation. Specific areas are divided into individual systematic chapters which are interlinked. The special emphasis is (put) on child soldiers in the world and individual international instruments which are providing the protection of them. The rigorous thesis deals with the relation between international humanitarian law, international conventions, European conventions and children's rights. The thesis is divided into five chapters and those are divided into several subsections. The first part of the thesis deals with the Convention on the Rights of the Child, especially the article one, three and thirty-eight. The thesis continues by the analyse of the phenomenon of child soldiers, which is the aim of the work, and trafficking of human beings and sexual exploitation. Práva dieťaťa a zásady jeho ochrany sú i dnes aktuálnou témou, ktorá si získava stále väčší záujem verejnosti. Predkladaná práca, ako je už z jej názvu zrejmé, sa zaoberá právami dieťaťa v medzinárodných dokumentoch. Ako cieľ som si vytýčila skúmať postavenie dieťaťa a jeho ochranu v oblastiach, ktoré sú podľa mňa problematické a hodné hlbšieho preskúmania. Oblasti jej skúmania sú rozdelené v jednotlivých kapitolách, ktoré sa systematicky delia a sú vzájomné prepojené. Dôraz sa kladie na problematiku detských vojakov vo svete a jednotlivé medzinárodné inštrumenty poskytujúci im ochranu. Táto rigorózna práca sa zaoberá aj vzťahom medzinárodného humanitárneho práva, medzinárodných dohovorov, európskych dohovorov a právami dieťaťa. Predkladaná práca sa delí na päť kapitol v rámci ktorých sa delí na niekoľko podkapitol. Začiatok práce je venovaný Dohovoru o právach dieťaťa, kde sa venujem najmä analýze článkov jedna, tri a tridsaťosem. Práca pokračuje skúmaním fenoménu detských vojakov, ktorý tvoria aj ťažisko práce a zneužívaniu detí na obchodovanie. Koniec práce je venovaný Organizácií spojených národov, Výboru pre práva dieťaťa, humanitárnemu právu ak aj ochrane práv dieťaťa v dokumentoch Európskej únie.
