Výklad náboženské svobody v evropské a mezinárodní praxi

Abstract

Shrnutí Tématem této diplomové práce je systém ochrany náboženských svobod v evropském a mezinárodním právu a její interpretace ve světle rozhodovací praxe Evropského soudu pro lidská práva a Výboru pro lidská práva u OSN. Skutečnost, že je ochrana náboženských menšin v posledních letech velice aktuálním tématem, dokládá právě velice bohatá judikatura mezinárodních soudů, jejíž rozbor je hlavní náplní práce. Cílem mé práce je pak poskytnout odpovědi na otázky, jakou pozici v systému ochrany základních lidských práv mezinárodní orgány ochraně náboženských menšin přisuzují a za jakých podmínek či situací může být výkon těchto práv omezen, aniž by se jednalo o zásah nepřípustný. Jelikož je náboženství ústředním pojmem celé práce, je v jejím úvodu poskytnut výklad tohoto pojmu a jeho pojetí v odborné literatuře. Druhá kapitola je věnována historickému vývoji ochrany náboženských svobod od dílčích instrumentů až k modernímu pojetí náboženské svobody zajištěné mezinárodními smlouvami poskytujícími ochranu základním lidským právům, včetně práv náboženských. Ve třetí kapitole je podrobně rozebrán systém zakotvení náboženských svobod v rámci Evropy, tedy jak na úrovni regionální, tak i na úrovni celosvětové, zaštítěné Organizací spojených národů. The interpretation of religious feeedom in European and international decision - making practice This diploma thesis focuses on the system of protection of religious freedoms in European and international legislation and explores its interpretation in the decision-making practice of the European Court of Human Rights and the United Nations Human Rights Committee. In recent years, the protection of religious minorities has become a topical issue, giving rise to numerous international judicial decisions. The core of the thesis provides a comprehensive analysis of some of these decisions. The aim of the thesis is to examine the importance international judicial bodies attribute to the protection of religious freedoms in relation to the system of the protection of fundamental human rights. It also discusses conditions and situations in which the exercise of these fundamental rights can be limited without encroaching upon fundamental freedoms of an individual. The introduction provides a definition of the term religion and describes its interpretation in specialized literature.
