Probační a resocializační programy pro mladistvé delikventy

Abstract

Předkládaná práce se zaměřuje na fenomén delikvence mládeže. Pozornost je věnována možným vlivům a faktorům, které ovlivňují vznik delikventního chování u dětí a mladistvých a samozřejmě následně možnostem reakce justice a soudů na toto nežádoucí chování ve společnosti. V právním systému ČR existuje samostatný právní předpis, který reaguje na protiprávní jednání mládeže, jedná se o zákon č. 218/2003, o soudnictví ve věcech mládeže. Zákon představuje možnosti reakce a dalšího zacházení s dětskými a mladistvými pachateli trestné činnosti. Je zde vymezena možnost ukládání probačních programů a spolupráce s Probační a mediační službou ČR, která zasahuje a pomáhá v řešení protiprávního jednání nejen dětí a mladistvých, ale také dospělých. Pozornost je věnována hlavně podobě a možnostem probačních programů, které jsou provozovány neziskovými nestátními organizacemi a pomáhají mladistvým pachatelům trestné činnosti uvědomit si své chování a především předcházet recidivě. K ilustraci vývoje kriminality páchané dětmi a mladistvými jsou připojeny přehledové tabulky, které ukazují na snižující se počet páchaných trestných činů v posledních 10 letech. The present thesis focuses on the phenomenon of juvenile delinquency. Attention is paid to influences and factors that influence the emergence of delinquent behavior in children and adolescents, and of course then the possibilities of justice and judicial response to this undesirable behavior in society. In the legal system of the Czech Republic, there is a separate piece of legislation that responds to the infringement of youth, it is the Law no. 218/2003. The Act represents a response options, and another dealing with children and juvenile offenders. In this Law is delimited the ability to store probation programs and cooperation with the Probation and Mediation Service, which intervenes and helps in dealing with infringements not only children and adolescents but also adults. Attention is paid mainly the form of options and probation programs that are provided by non-profit and non-governmental organizations to help juvenile offenders realize their behavior and above all to prevent recurrences. To illustrate the development of crimes committed by children and juveniles are attached overview tables, which indicate a decreasing number of crimes in the last 10 years.
