Abstract

Restorative Juvenile Justice This thesis is dealing with restorative juvenile justice. It aims to summarise and critically discuss this topic. It seeks to classify terms and theory used in order to help its readers with orientation throughout this issue as different terms and theories may often lead to unclarity and confusion. Subsequently it comes to a deeper analysis of selected parts. In particular, it examines international standards, describes thoughts of world-leading experts and eventually compares them and shows them on practical examples. Last but not least, it depicts selected theoretical foundations and draws connection between human life, inherent human nature, and use of restorative justice that is accepted as one of the main arguments for a higher effectivity in comparison to retributive justice. The thesis is divided into three parts. The first part deals with juvenile justice, children's rights and relevant international documents. The second part analyses restorative justice in general, compares different points of view and its types, and places it into a broader criminal justice framework. Shrnutí Restorativní justice v trestním soudnictví mládeže Práce se zabývá restorativní justicí v trestním soudnictví mládeže. Dává si za cíl shrnout a kriticky pojednat o daném tématu. Snaží se utříbit používané pojmy a teorie pro čtenářovu jednodušší orientaci v této problematice, neboť ty mohou často vést k nejasnostem a zmatečnostem. Následně přistupuje k hlubší analýze vybraných částí. Především rozebírá zakotvení mezinárodních standardů, přibližuje názory světových vědců a nakonec je srovnává a ukazuje na praktických příkladech. V neposlední řadě také shrnuje vybraná teoretická východiska a vykresluje souvislost mezi přirozeností lidského života a použitím restorativní justice, který je považován za jeden z hlavních argumentů pro vyšší účinnost ve srovnání s justicí retributivní. Práce je rozdělena do tří částí. První část pojednává o soudnictví ve věcech mládeže, dětských právech a jejich mezinárodní úpravě. Druhá část rozebírá restorativní justici obecně, srovnává různé pohledy na ni a její druhy a zakotvuje ji do širšího rámce trestního soudnictví. Následně na restorativní justici pohlíží z praktičtějšího hlediska kritickým pojednáním a praktickými příklady.
