Změny v kanonickém trestním právu po roce 1983

Abstract

Changes in canon penal law since 1983 The aim of the thesis is to introduce a well-arranged survey of all the changes that took part in the substantive canon penal law since the publication of the Code of Canon Law for the western (Latin) church in 1983. The first part of the thesis is dedicated to a brief overview of the history of canon law including the preparation of the publication of the new Code. In the second part, substantive canon penal law, which is nearly completely contained in the Book VI of the Code, is introduced in more detail. The third part chronologically lists all the changes that took part in the period from 1983 to 2021. The fourth part deals with current legislation promulgated by apostolic constitution of pope Francis Pascite gregem Dei. The last part of the thesis gives a brief evaluation of the development described in the preceding parts. There are two tables enclosed to the thesis, the first of which compares Book VI of the Code of Canon Law with the current norms of substantive penal law, the second contains the text of the new Book VI of the Code in Latin original with parallel Czech translation.

Cílem této práce je podat přehledné zpracování všech oněch změn, ke kterým došlo v kanonickém trestním právu hmotném od vydání Kodexu kanonického práva pro západní (latinskou) církev v r. 1983. První část práce je věnována stručnému přehledu dějin kanonického práva včetně přípravy vydání nového kodexu. Ve druhé části je podrobněji představeno trestní právo hmotné, které je prakticky úplně soustředěno v VI. knize kodexu. Třetí část chronologicky uvádí veškeré změny, ke kterým došlo v období od r. 1983 do r. 2021. Čtvrtá část se zabývá aktuální platnou právní úpravou promulgovanou apoštolskou konstitucí papeže Františka Pascite gregem Dei. V poslední části práce je uvedeno stručné zhodnocení popsaného vývoje. Přílohou práce jsou dvě tabulky, z nichž první srovnává VI. knihu Kodexu kanonického práva se současnými normami trestního práva hmotného, ve druhé je uveden text nové VI. knihy kodexu v latinském originále s paralelním českým překladem.
