Abstract

Alternativní tresty Abstrakt V předkládané rigorózní práci se věnuji problematice ukládání alternativních trestů v české trestní justici, zejména ukládání trestu domácího vězení. Cílem rigorózní práce je analyzovat ukládání alternativních trestů v České republice a popsat současný stav. V rámci trestu domácího vězení se zaměřuji zejména na výkon jeho kontroly (elektronický monitoring). Práce je členěna do šesti samostatných kapitol. První kapitola je teoretickým úvodem do dané problematiky a pojednávám v ní o definici trestu, jeho účelu, systematice a zásadách jeho ukládání. Druhá kapitola se věnuje analýze východisek alternativního trestání a principům fungování restorativní justice, probace a mediace. Ve třetí kapitole se zaměřuji na vývoj právní úpravy trestání v České republice, a to zejména s ohledem na alternativní tresty. Analyzuji především právní úpravu od přijetí trestního zákoníku z roku 2009 včetně následných novel. Ve čtvrté kapitole věnuji pozornost statistickému vývoji ukládaných trestů v České republice. Uvádím statistiky všech odsouzených, odsouzených k trestu domácího vězení a k dalším alternativním trestům. V páté kapitole se zaměřuji na trest domácího vězení. Zmiňuji podmínky jeho uložení, způsob jeho výkonu a kontroly a analyzuji jeho výhody a nevýhody. V šesté kapitole jsem se zabývala...

Alternative punishments Abstract This careful study is devoted to the issue of imposing alternative punishments in the Czech criminal justice system, in particular the imposition of house arrest. The aim of this work is to analyze the imposition of proposed alternative punishments in the Czech Republic and also to describe the current state punishment system. When examining the sentence of house arrest, I focus mainly on the performance of its control (electronic monitoring). The work is divided into six separate chapters. The first chapter is a theoretical introduction to the given issue and in it I discuss the definition of punishment, its purpose, systematics and principles of its imposition. The second chapter analyzes the starting points of alternative punishment and the principle functions of restorative justice, probation and mediation. In the third chapter, I focus on the development of regulation in legal punishment in the Czech Republic, especially with regard to alternative punishments. I mainly analyze the legislation since the adoption of the Criminal Code of 2009, including subsequent amendments.
