Sdílení fotografií dětí jejich rodiči na sociálních sítích

Abstract

This theoretical based bachelors theses is focused on phenomenon of sharing pictures of children online by their parents, so called sharenting (especially on Facebook or Instagram). There are risks connected to this kind of sharing, such as formation of a digital footprint, which could include sensitive information, details from personal life or other problematic information, which would never be shared by children it concerns. This work attempts to capture the consequences this sharing could have for a life of a child outside of online world as well as for their online presence. All these phenomena will be described in theory but also by a legal perspective. Considering the terms and conditions of use published by META or other legal documents, this work attempts to answer following questions: To what extend is sharing this information unsafe? Can the child seek legal defence? And what legal boundaries are there for this kind of sharing? By analysing and interpreting academic and other relevant texts, together with legislation and jurisdiction, this work presents a conclusion, that such sharing could be a violation of privacy of a child, which would go hand in hand with violation of obligatory care for the child deriving from parental responsibility. Tato bakalářská diplomová práce se zabývá sdílením fotografií dětí jejich rodiči na sociálních sítích (zejména pak na síti Facebook či Instagram). Tento fenomén je známý jako sharenting. V teoretické i právní rovině jsou v této práci popsány jevy související s tímto sdílením, jako například vznik digitální stopy, která často obsahuje citlivé informace, detaily ze života nebo jinak problematické informace, které by o sobě samy dotčené děti nikdy nesdílely. Dále se práce zaměřuje na možná rizika těchto digitálních stop. Ať už by šlo o jejich zneužití jinými uživateli nebo jejich využití samotnou společností META pro budoucí účely reklamy, popřípadě jejich důsledky pro život dítěte mimo online svět. S přihlédnutím k vlastním podmínkám využívání platforem společnosti META i právním předpisům se práce pokouší odpovědět na otázky do jaké míry je toto sdílení nebezpečné, jaké má dítě možnosti se bránit a jaký je právní rámec této problematiky. Tato práce je vystavěna na analýze a interpretaci množství odborných i jinak relevantních textů, spolu s právními předpisy a soudními případy, na základě kterých vytváří odborný i právní rámec této problematiky. Identifikuje také prostor pro zásah státu ze strany soudů a legislativy, který by byl, podle názoru autorky, v mnohých případech vhodný.
