Abstract

Binarita pohlaví a genderu v českém právu Abstrakt Tato práce se zabývá lidskými právy intersex lidí v kontextu binarity pohlaví a genderu. Klade si za cíl zodpovědět otázku, jak jsou v českém právu, založeném na binární registraci pohlaví, chráněna lidská práva intersex lidí. Text identifikuje, jak binarita pohlaví a genderové identity prozařuje do české legislativy a judikatury a rovněž představuje odlišné diskurzy, které o variacích pohlavních znaků vytváří různé narativy. Stěžejní částí práce je analýza zakotvení ochrany lidských práv se zaměřením na právo na osobní integritu, na sebeurčení, a nediskriminaci v mezinárodním lidskoprávním rámci a míra odrazu této ochrany v českém právu. Skrz celou práci je pak reflektováno, jak binarita pohlaví a jednotlivé diskurzy mohou ochranu práv intersex lidí v českém prostředí ovlivňovat. Nakonec jsou při současné komparaci s německou právní úpravou nastíněny opatření de lege ferenda, včetně úvahy nad vhodností vytvoření nebinární registrace pohlaví u intersex lidí. 1 Sex and Gender Binary in Czech Law Abstract The thesis deals with the human rights of intersex people in the context of sex and gender binary. It aims to answer the question of how the human rights of intersex people are protected under Czech law, which is based on binary sex registration. The text identifies how sex and gender identity binary permeates Czech legislation and jurisprudence, as well as presents different discourses that create various narratives about variations of sex characteristics. The central part of the thesis analyses the protection of human rights of intersex people, focusing on the rights to personal integrity, self-determination, and non- discrimination within the international human rights framework, and the extent to which this protection is reflected in Czech law. Throughout the thesis, it is reflected how sex binary and different discourses may influence the protection of intersex people's rights in the Czech context. Finally, in comparison with German law, measures de lege ferenda are outlined, including considerations on the appropriateness of legislating a non-binary sex registration for intersex people.
