Trest zákazu činnosti a jeho kontrola

Abstract

Tato diplomová práce se zabývá problematikou trestu zákazu činnosti, jeho výkonu a kontroly. Cílem této diplomové práce je poskytnout základní vhled do problematiky trestů a trestání, zejména se zaměřením na trest zákazu činnosti, jeho výkonu a kontroly. Práce je rozdělena do sedmi kapitol. První kapitola této práce se zabývá teoretickým základem, ve kterém se autorka zaměřuje zejména na vymezení pojmu a účelu trestů, jednotlivé teorie trestání, systém trestů a v závěru kapitoly též na problematiku ochranných opatření, jakožto zvláštního typu trestních sankcí. Druhá kapitola této práce se zabývá obecně trestem zákazu činnosti, podmínkou souvislosti se spáchaným trestným činem, rozsahem, výměrou a okruhem zakazovaných činností. Ve třetí kapitole se autorka věnuje úpravě v zákoně o soudnictví ve věcech mládeže, tedy trestními opatřeními zákazu činnosti. Čtvrtou kapitolu autorka věnuje úpravě v zákoně o trestní odpovědnosti právnických osob a specifikům trestu zákazu činnosti ukládaného na základě tohoto zákona. Pátá kapitola této práce se zaměřuje na výkon trestu zákazu činnosti, podmíněným upuštěním od výkonu zbytku trestu zákazu činnosti a zahlazením odsouzení. This thesis addresses the issue of the punishment of disqualification, its execution, and supervision. The aim of this thesis is to provide a basic insight into the issue of penalties and punishment, with a particular focus on the punishment of disqualification, its execution, and supervision. The work is divided into seven chapters. The first chapter addresses the theoretical foundation, where the author focuses primarily on defining the concept and purpose of penalties, various theories of punishment, the system of penalties, and at the end of the chapter, also on the issue of protective measures as a special type of criminal sanction. The second chapter discusses the punishment of disqualification in general, the requirement of its connection with the committed crime, its scope, determination, and the range of prohibited activities. In the third chapter, the author focuses on the regulation in the Juvenile Justice Act, specifically on the penal measures related to activity prohibition. The fourth chapter is dedicated to the regulation in the Act on Criminal Liability of Legal Persons and the specifics of the punishment of disqualification imposed under this law.
